Terms of Use
Rules governing access to and use of IA-IMAGE.ONLINE.
1. Acceptance of the Terms
These Terms of Use (“Terms”) govern access to and use of the website and services offered through ia-image.online (“Service”). By accessing, browsing, creating an account, purchasing credits, uploading content, generating images, or otherwise using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Service.
2. Operator of the Service
The Service is operated by Brandonn – Sole Proprietor, identified in the Legal Notice available on the website.
3. Eligibility
You represent and warrant that you are legally capable of entering into a binding agreement and that your use of the Service complies with all laws and regulations applicable to you.
If you use the Service on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms.
4. Age Requirements and Content Safety Filters
The Service includes content safety filters enabled by default in order to reduce the generation of potentially sensitive or inappropriate content.
In certain cases, these filters may mistakenly restrict content that is otherwise lawful or appropriate (“false positives”). If a user believes that legitimate content is being blocked, the user may choose to disable the safety filters.
Disabling safety filters may allow the generation of sensitive or mature content. By disabling such filters, you represent and warrant that you are at least eighteen (18) years old and legally permitted to access such content in your jurisdiction.
The Service is not designed or intended as a primary platform for generating or distributing adult content. Users remain solely responsible for any content generated after disabling safety filters and for ensuring compliance with applicable laws, third-party rights, and these Terms.
5. Nature of the Service
IA-IMAGE.ONLINE provides access to AI-assisted image generation, image editing, prompt assistance, project organization, sharing tools, and related digital tools.
Generated outputs may vary significantly depending on prompts, settings, models, third-party providers, content filters, infrastructure conditions, and other technical factors. No specific output, style, quality level, business result, or commercial suitability is guaranteed.
6. Account Security
Certain features may require an account. You are responsible for maintaining the confidentiality of your credentials and for all activities occurring under your account, whether authorized by you or not, unless caused exclusively by the operator’s fault.
You must immediately notify the operator of any unauthorized access, suspected breach, or misuse of your account.
7. Credits, Plans, and Service Access
Some features of the Service require paid credits, one-time packs, subscriptions, or other paid access mechanisms.
Credits are digital usage units that allow access to certain operations on the Service. The number of credits consumed may vary depending on the model used, resolution, processing type, editing operations, selected settings, or future changes to the Service.
Any image counts, examples, estimates, or usage illustrations shown on the website are for guidance only and do not constitute a guarantee.
Subscription credits may be subject to rollover limits, plan limits, expiration logic, plan changes, cancellation rules, and other terms described on the pricing pages or applicable sales terms.
8. No Refund Principle for Consumed Digital Services
To the maximum extent permitted by applicable law, purchases relating to digital credits, subscriptions, and digitally delivered services are non-refundable once the digital service has begun, the credits have been granted, or the Service has been made available, except where a mandatory legal right applies.
Nothing in these Terms limits any non-waivable rights that consumers may have under applicable law.
9. Acceptable Use
You agree not to use the Service:
- for any unlawful, fraudulent, abusive, or deceptive purpose;
- to infringe intellectual property, privacy, image rights, publicity rights, trade secrets, or other rights;
- to generate, upload, request, distribute, share, or promote content that is illegal, exploitative, hateful, violent, defamatory, harassing, deceptive, non-consensual, or otherwise prohibited by law;
- to impersonate another person or misrepresent affiliation, endorsement, identity, or origin;
- to create or distribute malware, phishing material, scams, spam, or harmful code;
- to reverse engineer, probe, scrape at scale, overload, interfere with, or circumvent the Service or any security or usage controls;
- to bypass content moderation, technical limitations, pricing logic, or access controls;
- to use the Service in a way that may expose the operator to legal, regulatory, reputational, or security risk.
10. User Inputs, Uploads, and Prompts
You are solely responsible for all prompts, text, instructions, reference images, uploads, metadata, and other content you submit to the Service (“Inputs”).
You represent and warrant that you have all rights, licenses, permissions, and legal bases necessary to use, upload, and process your Inputs through the Service, including where personal data, image rights, trademarks, copyrighted works, or confidential materials are involved.
The operator has no general obligation to verify the legality, ownership, or accuracy of your Inputs.
11. AI Outputs
The Service may generate images, edits, transformations, text suggestions, or other outputs (“Outputs”) using automated systems and third-party AI models.
Outputs may be inaccurate, unexpected, biased, misleading, visually flawed, legally sensitive, or similar to content generated for other users. You remain solely responsible for reviewing and validating Outputs before using, publishing, licensing, selling, sharing, or relying on them.
The operator makes no warranty that any Output:
- will be unique or exclusive;
- will be free of third-party claims;
- will be fit for commercial use, trademark use, or legal registration;
- will comply with platform rules, marketplace rules, advertising rules, or local laws in your jurisdiction.
12. Rights in Inputs and Outputs
As between you and the operator, and subject to applicable law and third-party provider terms, you retain ownership of your Inputs.
Subject to your compliance with these Terms, the operator grants you any rights in Outputs that the operator is legally able to grant, if and to the extent such rights arise. However, no warranty of title, exclusivity, originality, non-infringement, or worldwide enforceability is provided.
You acknowledge that the legal status of AI-generated content may vary by jurisdiction and may evolve over time.
13. License Granted to Operate the Service
You grant the operator a non-exclusive, worldwide, royalty-free license, for the duration necessary to provide the Service, to host, store, reproduce, process, transmit, adapt, display, and technically use your Inputs and Outputs solely for purposes such as operating the Service, generating requested content, preventing abuse, ensuring security, complying with legal obligations, troubleshooting incidents, and improving service reliability.
14. Public Share Links
The Service may allow users to generate public share links for certain images or outputs. You remain solely responsible for any content that you choose to share publicly, including compliance with applicable law, third-party rights, image rights, privacy rights, and these Terms.
The operator does not undertake a general obligation to review shared content before publication. However, the operator may disable, restrict, unpublish, or delete any public share link or associated content at any time and without prior notice where reasonably necessary for legal compliance, safety, rights protection, abuse prevention, platform integrity, or risk management.
15. Moderation and Enforcement
The operator may, at any time and without prior notice, monitor, block, refuse, remove, disable access to, restrict, flag, review, unpublish, or retain for evidentiary purposes any account, Input, Output, public share link, transaction, or activity if reasonably considered necessary for safety, legal compliance, intellectual property protection, anti-fraud measures, platform integrity, abuse prevention, or risk management.
This includes content or activity that may be illegal, infringing, non-consensual, deceptive, abusive, harmful, or otherwise in breach of these Terms or applicable law, whether detected proactively or following a complaint, report, legal request, or internal review.
The operator may suspend or terminate access immediately in case of suspected misuse, payment incident, legal claim, security risk, attempted circumvention, prohibited content, repeated violations, or any breach of these Terms.
16. Preservation of Evidence and Cooperation
The operator may preserve relevant logs, metadata, transaction records, prompts, uploads, generated outputs, account identifiers, technical records, and moderation records where reasonably necessary for security, fraud prevention, legal compliance, dispute handling, enforcement of these Terms, or cooperation with competent authorities or rights holders.
17. Reporting Mechanism
Users or rights holders may report content or activity believed to be illegal or in violation of these Terms by contacting the operator through the contact details made available on the website.
Reports should contain sufficient information to identify the content concerned and explain the reason for the report. The operator may review and act on such reports in its discretion and in accordance with applicable law.
18. Third-Party Providers
The Service may rely on third-party providers for payment processing, AI inference, cloud hosting, storage, analytics, moderation, security, email delivery, and other functions.
Certain features, outputs, limitations, prices, safety layers, availability, and processing times may depend on those third parties and may change without notice.
19. Service Changes
The operator may modify, replace, suspend, discontinue, restrict, or update any part of the Service, including plans, credit costs, models, features, limits, availability, interface, moderation rules, and technical specifications, at any time.
The operator shall not be liable for the removal, unavailability, replacement, or evolution of any model, feature, integration, or third-party dependency.
20. Intellectual Property of the Service
The Service itself, including its design, code, structure, trademarks, branding, databases, interfaces, workflows, and non-user content, remains the exclusive property of the operator and/or its licensors.
Except as expressly permitted, no license or right is granted to you by implication or otherwise.
21. Privacy
Use of the Service may involve the processing of personal data. Please refer to the Privacy Policy and Cookie Policy for information about how personal data and technical identifiers are handled.
22. Disclaimer of Warranties
To the fullest extent permitted by law, the Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, statutory, or otherwise.
The operator disclaims, to the fullest extent permitted by law, all warranties including merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, security, compatibility, accuracy, reliability, and error-free operation.
23. Limitation of Liability
To the fullest extent permitted by applicable law, the operator shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, loss of savings, loss of business opportunity, loss of data, loss of content, reputational damage, or interruption of activity.
This includes, without limitation, damages resulting from generated outputs, user reliance on outputs, content claims, third-party provider failures, account suspension, loss of access, moderation actions, payment issues, or changes to the Service.
Subject to mandatory legal rules that cannot be excluded, the operator’s total aggregate liability for all claims arising out of or relating to the Service shall not exceed the total amount paid by you to the operator during the three (3) months preceding the event giving rise to the claim.
24. Indemnification
You agree to defend, indemnify, and hold harmless the operator and its partners, service providers, subcontractors, and licensors from and against any claims, actions, proceedings, liabilities, damages, losses, fines, penalties, costs, and expenses (including reasonable legal fees) arising out of or related to:
- your use or misuse of the Service;
- your Inputs or Outputs;
- your public sharing of content;
- your breach of these Terms;
- your violation of any law or third-party right.
25. Termination
The operator may suspend, restrict, or terminate your access to the Service at any time, with or without notice, if reasonably necessary for security, compliance, abuse prevention, payment enforcement, risk control, or breach of these Terms.
Upon termination, your right to access and use the Service ceases immediately. Clauses which by their nature should survive termination shall survive, including liability limitations, indemnity, intellectual property, governing law, dispute clauses, and payment-related provisions.
26. Governing Law and Jurisdiction
These Terms are governed by French law. Subject to mandatory consumer protection rules, any dispute arising from or relating to these Terms or the Service shall be submitted to the competent French courts.
27. Severability
If any provision of these Terms is held to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
28. No Waiver
Any failure by the operator to enforce any provision of these Terms shall not be deemed a waiver of that provision or of any other provision.
29. Changes to the Terms
The operator may update these Terms at any time. The version published on this page is the version currently applicable. Continued use of the Service after an update constitutes acceptance of the revised Terms.
